The Technical Regulation of the Eurasian Customs Union TR CU 021/2011 On safety of food sets the requirements for food safety, including the manufacturing, labelling, distribution, transport, storage, disposal and requirements for certain types of food in the territory of customs union.
The aim of the Technical Regulation is the protection of human life and health, the environment, as well as preventing the consumer being given misleading information.
According to the Technical Regulation TR CU 021/2011, food shall be safe during the minimum shelf life when used as directed. The relevant limit values for food are laid down in the Annexes to the Technical Regulation.
Pathogens and their toxins, which could endanger the health of humans and animals, are not permitted in food.
The conformity assessment with the requirements of the Technical Regulation TR CU 021/2011 is a prerequisite for the import and sale of goods within the customs union.
Food which does not comply with the requirements of this Technical Regulation, including food with an exceeded due by date, must be withdrawn from the market independently by the owner or by the responsible supervisory authorities.

Until February 15, 2015, it was possible to place products on the market that conformed with the national standards of the technical regulation of the member states of the customs union, e.g. GOST certificate, if the proof of conformity has been issued before the entry into force of the Technical Regulation TR CU 021/2011. After this date, only products declared in accordance with TR CU 021/2011 and marked with the EAC conformity marking may be placed on the market.
The Technical Regulation TR CU 021/2011 applies to:
foodstuff
processes of production, storage, transportation, distribution and disposal of food
The technical regulation TR CU 021/2011 does not apply to food which has been produced by private persons at home or in private companies. Furthermore, it is not intended to be used for the production, storage, transport and disposal of food intended solely for personal use and not for free circulation.
For the food itself, as well as for its production, distribution, transport, storage and disposal, the following forms of the conformity assessment are provided:
EAC Declaration
State registration of specialised food
State registration of new types of food
Veterinary and hygiene control
unprocessed food of animal origin
special food
vinegar
The EAC Declaration is carried out accordance with one of the three procedures, at the choice of the applicant: for the serial delivery, for one-time supply and for serial production.
The validity of the EAC Declaration shall be determined by the applicant unless otherwise specified in the Customs Unions Technical Regulation for certain types of food.
The conformity assessment in the form of EAC Certification is not intended for food.
The following products are subject to the state registration:
baby food, including water
products for dietary-therapeutic and dietary-preventive nutrition
mineral water with a mineral content of more than 1 mg / dm3
food for athletes, pregnant and lactating women
biologically active additives
new types of food
In addition, the manufacturing plants which process products of animal origin are subject to the state registration. These include:
slaughter of animals and poultry
processing of animal and poultry meat
extraction of raw milk, raw milk cream and its processing
manufacture of dairy products
production and processing of eggs
production and processing of aquacultures
The state registration of food products is carried out by the notified body approved by the member state of the customs union.
Information on the state registration of the food is stored in a single register. The supervisory authorities in the field of food safety are responsible for the management and administration of this database.
Before entry into the customs union of the Eurasian Economic Union (EAEU), unprocessed food of animal origin is subject to veterinary and hygiene control.
The processed foods of animal origin, on the other hand, are not subject to veterinary and hygiene control.
The veterinary and hygiene checks and its results shall be carried out in accordance with the legislation of the member state of the Eurasian Economic Union and the arrangement of said member state of the customs union concerning veterinary and hygienic measures.
The data on the state registration of businesses is entered in the uniform register of production facilities for the production of food.
The products declared according to TR CU 021/2011 shall be marked with the EAC marking.
Detailed requirements for the food marking are specified in TR CU 022/2011 On food marking.
The EAC marking of unpackaged food must be applied to the shipping papers.
The food in circulation, including raw materials for the food industry, must have appropriate accompanying documents to ensure the traceability of the product.
The EAC Declarationfor food is valid for 5 years.
